GENERAL TRADING TERMS AND CONDITIONS FOR CLAY BRICKS AND PAVING PRODUCTS MANUFACTURED BY AUSTRALIA’s BOUTIQUE BRICK MAKER PTY LTD T/A LITTLEHAMPTON CLAY BRICKS AND PAVERS (ABN 51 667 901 733 / ACN 667 901 733).

Littlehampton Clay Bricks and Pavers recommends the use of washed concrete sand as the best base for all natural clay pavers, in line with accepted industry best-practice. The use of any other material may increase the degree of efflorescence. Littlehampton Clay Bricks and Pavers also strongly recommends that pavers be laid on a well-drained site to help to reduce the deterioration of the product exposed to abnormal quantities of water. Littlehampton Clay Bricks and Pavers will not be responsible for any deterioration where bricks are insufficiently damp or water-proofed or where they are subject to abnormal quantities of water. It is characteristic of all the light burning clays from which bricks are manufactured Littlehampton Clay Bricks and Pavers in South Australia that they contain small quantities of natural salts called vanadium salts. These water-soluble salts can leach to the surface of bricks and crystallise there as moisture dries from the brickwork. The resulting efflorescence is coloured yellow/ brown/ green/ blue. Vanadium Efflorescence does not cause any damage to the structure and characteristics of Littlehampton Clay Bricks and Pavers products, nor will the treatments approved by Littlehampton Clay Bricks and Pavers to remove the colouring. Size Variation

The stated sizes of all Littlehampton Clay Bricks and Pavers products are nominal sizes only. Size variation within accepted industry standards can occur because of the manufacturing

Colour Variation

All natural clay Bricks and Pavers are sold as a blend. This is a characteristic resulting from the manufacturing process and the natural raw material. Colour variation will occur, including bar marks. All endeavours are made to match samples and keep orders consistent. In line with industry standards, Littlehampton Clay Bricks and Pavers recommends when laying clay bricks or pavers to work from 3 pallets at any one time. It is strongly recommended that enough product to complete the entire project be ordered at one time to ensure a cohesive result.

Breakage & Chipping

Every effort is made by Littlehampton Clay Bricks and Pavers to minimise breakage and chipping. Littlehampton Clay Bricks and Pavers and its associated companies will not accept claims for chipping and breakages under 5% of the number ordered.

Made-to-order Products

Quantities of stocked product exceeding normal quantities held by Littlehampton Clay Bricks and Pavers, and Custom-made products are considered ‘Made-to-Order’. A non-refundable deposit of 30% of the total invoice amount is required before Littlehampton Clay Bricks and Pavers will commence production of made-to-order products. Made-to-order products have a lead-time of 12 weeks from payment of deposit. Once manufactured, made to order products will be stored by Littlehampton Clay Bricks and Pavers for a maximum of 8 (eight) weeks before demurrage charges will be applied. The manufacture of made-to-order product is considered a creative collaboration between the customer and the brickmakers of Littlehampton Clay Bricks and Pavers. It is important to understand the characteristics of working with Natural Clay, using traditional making methods and tools. While every effort is made to make products that fit custom requirements for shape and colour, it must be expected that there will be some percentage variation in both parameters. This is the charm of our artisanal products, not a defect. The development of custom products incurs costs through design, formulation, trials, tooling, labour and storage. These costs are shared between Littlehampton Clay Bricks and Pavers and the customer, to be agreed before the commencement of any trials or manufacture. All intellectual property remains the property of Littlehampton Clay Bricks and Pavers.

Demurrage

Where products have been made-to-order or an order has been placed, whether paid for in part or otherwise, Littlehampton Clay Bricks and Pavers will hold/ store stock on the customers behalf for a maximum of 8 (eight) weeks before demurrage charges will be applied. Demurrage charges will be assessed and applied based on market rates at the time of accrual.

Returns

Littlehampton Clay Bricks and Pavers will not accept returns. Claims for faulty products will not be accepted once laid. No returns will be accepted from over ordering by either client/builder or from estimations completed by Littlehampton Clay Bricks and Pavers.

Delivery

48hrs notice is required for Adelaide Metropolitan deliveries. All other deliveries require 5 (five) business days’ notice. Littlehampton Clay Bricks and Pavers’ free delivery policy applies to orders of 4 (four) pallets of First-Grade product and over delivered within the Adelaide Metropolitan Area. Charges for deliveries outside of the metropolitan area, or for orders within the Adelaide Metropolitan Area that do not meet the minimum quantity are available upon request from the Littlehampton Clay Bricks and Pavers Dispatch Office.

It is the customers’ responsibility to ensure that our drivers have ease of access to site at delivery. Delays caused by unreasonable access to site due to building materials, vehicles or other obstructions at the agreed time of delivery will incur a fee based on charges passed on to Littlehampton Clay Bricks and Pavers by our freight providers.

Handling Fees

For order quantities of less than one pallet, or in any increment of less than one pallet, a handling fee of $50.00 will apply to each pallet that requires additional handling and wrapping by Littlehampton Clay Bricks and Pavers.

Site Damage

Littlehampton Clay Bricks and Pavers engage professional third party contractors to deliver our products. Our contractors make every effort to ensure safe and incident-free delivery. However, accidents can occur, and Littlehampton Brick Company and its associated companies will not be responsible for any damage or injuries to persons, creatures or property. Please ensure that our drivers have ease of access to site to minimise the chance of site damage.

Site Shifts

Littlehampton Clay Bricks and Pavers takes no responsibility for poorly prepared sites and will not take responsibility for product placement on sites with inadequate access. Littlehampton Clay Bricks and Pavers will not move any product other than bricks or pavers supplied Littlehampton Clay Bricks and Pavers, and any site shifts will be carried out at the customer’s expense.

Pallet Deposit

Littlehampton Clay Bricks and Pavers reserves the right to deliver on pallets and charge the purchasers account with $33.00 per pallet. Pallets will at all times remain the property of the Littlehampton Clay Bricks and Pavers and a full refund will be given within 12 months of delivery, on return of the pallets in good condition. Pallets delivered outside the metropolitan area will incur the $33.00 pallet deposit and are to be returned at the expense of the purchaser. Littlehampton Clay Bricks and Pavers will not accept any costs incurred with the return freight of pallets.

Pallet Strapping

The Littlehampton Brick Company is required by law to have all products strapped for transport. This is a measure we take to ensure that the product order is delivered to site in full and to minimise the risk of product loss during transportation.

Trading Terms & Payments

All product will remain the property of Littlehampton Clay Bricks and Pavers until the account is paid in full under any negotiated trading terms as stipulated by the Littlehampton Clay Bricks and Pavers Accounts Department. Littlehampton Clay Bricks and Pavers reserves the right to delay delivery in any case where an account falls overdue. All fees and charges incurred by a collection agency for accounts deemed to be in default by Littlehampton Clay Bricks and Pavers Accounts Department will be payable by the account holder.
